Hamlet †Shakespeare Essay

Hamlet is a moral avenger in a corrupt and unjust world. He is the only person who questions the moral atmosphere of Denmark but is driven to act irritationally because of the distress placed on him by the world. Hamlet struggles with his duty to his father, his disillusionment with himself, his revenge on Claudius, his mother’s sudden remarriage, the purpose of the ghost and the corrupt nature of Denmark. By not informing the audience of the intentions of the ghost, Shakespeare keeps them engaged by creating disillusionment through Hamlet’s struggle for the truth. Furthermore, Shakespeare continues to engage audiences by presenting ideas of duty and corruption which are shown largely through the characterization of Hamlet. Hamlet struggles with his thoughts and feelings. The degree to which his alienation and melancholy signalled in his behaviour varies from production to production due to his father’s death. ‘O that this too too solid flesh would melt, thaw and resolve itself into a dew, or that the everlasting had not fixed his canon ’gainst self-slaughter. O God, God, how weary, stale, flat and unprofitable seem to me all the uses of this world! (Act 1 Scene 2). This quotation is Hamlet’s first soliloquy which signifies his first thoughts about suicide and how the world seems â€Å"weary, stale, flat, and unprofitable†. It conveys that he sees the world as a neglected garden grown foul. It also uses extended metaphor to articulate his strong desire to rest in peace. In other words, Hamlet finds suicide a desirable alternative to life in a painful world but this option is closed to him because it is forbidden by religion. Hamlet exposes the range of his depression: weariness, despair, grief, anger, nausea, loathing and disgust, resignation. The importance of this soliloquy lies in its establishing of Hamlet’s personality and revealing his mental condition. It presents Hamlet’s struggle for life and the disillusionment he feels towards the world. Through this, the audience therefore gain a closer relationship with Hamlet, and are absorbed by him because they are able to resonate with his circumstances, as he is faced with enduring truths of the human condition. Hamlet’s disillusionment with himself is largely driven by the disgust towards his mother’s sudden remarriage. In Act 1 Scene 2, Hamlet is dressed in black, signifying grief for his dead father. His appearance contrasts strikingly with the costumes and attitudes of the courtiers celebrating the wedding of Claudius and Gertrude. In this soliloquy, Hamlet describes his intense disgust at his mother’s second marriage to his despised uncle so soon after his father’s death. ‘Hyperion to a Satyr†¦those shoes were old with which she following my poor father’s body’ (Act 1 Scene 2). He describes the haste of their marriage through irony, noting that the shoes his mother wore to his father’s funeral were not worn out before her marriage to Claudius. The technique metaphor and juxtaposition are used to recall his dead father as infinitely superior to Claudius (his father was â€Å"so excellent a king†, a â€Å"Hyperion† which is the sun god; while Claudius is a bestial â€Å"satyr†, a lecherous creature, half-man, half-goat). He recalls how tenderly and protectively his father loved his mother, and how passionately she loved him. Hamlet condemns the marriage and struggle to accept that his mother betrayed his father but sorrowfully vows silence. Here, the audience is engaged through a deep understanding of Hamlet’s emotional feelings and the circumstances of betrayal in a relationship. Hamlet’s struggle for the truth of the Ghost’s intentions engages audiences with many possible interpretations that follow. In Act 1 Scene 4, Hamlet’s meditation on human nature is interrupted by the appearance of the Ghost. He sees it as ‘a questionable shape’, and the question it poses for him will haunt him for much of the play: is it good or evil? Hamlet’s uncertainty whether the Ghost is an agent of God or the Devil is expressed in three vivid antitheses and three rhetorical questions: â€Å"Be thou a spirit of health, or goblin damned, bring with thee airs from heaven or blasts from hell, by thy intents wicked or charitable†¦say, why is this? Wherefore? What should we do? † (Act 1 Scene 4). The Ghost claims he is the spirit of Hamlet’s father and orders him to revenge his murder. In Shakespeare’s time, revenge was forbidden by state and Church alike. The Church considered revenge as a sin for which the revenger’s soul was damned, condemning him to suffer everlasting torments after death. Therefore, the Ghost is seen by audiences as a devilish spirit sent to tempt Hamlet into an action that will result in his suffering for eternity. Here, audiences are engaged through Shakespeare’s dramatic treatment of Hamlet’s struggle for the truth and his disillusionment with the Ghost. Hamlet is hungry for revenge, but unsure if he knows the truth. His thoughts, emotions, and desire for action struggle with each other. In the soliloquy of Act 4 Scene 4, triggered by Fortinbra’s ruthlessness, Hamlet begins to realise his excessive over-thinking. It dawns upon him that he had been thinking too much and acting too little. ‘Now, whether it be bestial oblivion, or some craven scruple of thinking too precisely on th’event†¦I do not know why yet I live to say this thing’s to do, sith I have cause, and will, and strength, and means to do’t’. Due to his delays in action, Hamlet criticizes himself as a coward, with insults in the soliloquy ‘O what rogue and peasant slave am I!†¦ why, what am I! ’ (Act 2 Scene 2). Hamlet is self-abusive in his expressions and shows deep depression through the comparison of himself to the lowest and most worthless thing he can think of. Hamlet himself is more prone to â€Å"apprehension† than to â€Å"action†, which is why he delays so long before seeking his revenge on Claudius. Hamlet’s struggle to take action builds the climax throughout the play and keeps audiences engaged with the many questions and interpretations that follow from his indecisive and uncertainties to bring action upon his duty to his father. Hamlet is polarised due to his disillusionment with the corrupt state of Denmark. Denmark is frequently described as a physical body made ill by the moral corruption of Claudius and Gertrude, and many observers interpret the presence of the ghost as a supernatural omen indicating that ‘something is rotten in the state of Denmark’ (Act 1 Scene 4). This personification indicates that King Claudius is what is â€Å"rotten† in Denmark. The line spoken by Marcellus help create the sense of corruption that will grow increasingly throughout the play. He expresses disgust at the physical corruption that follows death in the metaphor ‘Imperious Caesar, dead and turned to clay,/ might stop a hole, to keep the wind away’ (Act 4 Scene 1). As Hamlet surveys the rather pathetic remains of Yorik, he realizes that even a praised man like Caesar has by now become a bit of clay that may be used to patch a lowly farmhouse wall. Like the body of a king going through the guts of a beggar, as part of the naturalness of the cycle of death, he presents the idea that the body of man is part of the earth and goes back to earth. Hamlet becomes especially concerned with the meaning of existence in addition to that of those around him, and he finds it difficult to reason what may become of him after his worldly life. He questions whether man’s spirit is important and after all, does the legacy people leave behind really matter when they’re dead? Consequently, Hamlet hesitates to take action upon his revenge on Claudius and struggles to find an answer to the questions he consistently asks himself. Here, audiences are presented a rather detached view of events that continues to engage them through the dramatic treatment of struggle and disillusionment of Hamlet. In conclusion, it is clear that Hamlet’s life contains many minor problems that make up the big problem. The Ghost of his father appearing to him is what began Hamlet’s morality and excessive thought. Thus, melancholia causes Hamlet a lot of grief and struggle to remain alive in this ambiguous world. Hamlet questions his own nobility, and deciding that he must die to be noble is a contributing factor in Hamlet’s lack of haste in murdering Claudius. Further, the internal struggle between contemplation and action, as well as the struggle to accept human mortality itself represents the audiences’ own struggle to comprehend the nature of tragedy. His struggle with uncertainty and the conflict that emerges between fate and freewill have a universal relevance as they continue to be key existential concerns, which strike a chord with contemporary audiences.

The college admissions process isn’t just difficult for the teens who endure it themselves. It’s difficult for their parents, too, and some of us might even argue that we’re up at night just as often as they are, silently stressing about the process. If you’re like many parents going through the college admissions process, you might struggle to find the balance between supportive cheerleader and overbearing taskmaster. This can be particularly true during parts of the process that you undertake together, such as college visits. You may feel that you have a financial and personal interest in your child’s college search and as such, it can be difficult to take a backseat. Rest assured, though, that you can still support and encourage your child before, during, and after college visits without making the visit more about your interests than your child’s. In this post, we’ll discuss how you can help your teen to prepare for a college visit, how you can support your teen during a college tour, and how you can help your teen to process his or her impressions afterwards. To learn more about how to make the most of college tours with your teen, keep reading. Before the tour itself, make sure that your teen understands that college tours aren’t a passive process. He or she should be prepared to ask valuable, insightful questions to help guide his or her experience. Encourage your child to research the school in advance, learning about departments or programs that might be of interest and compiling a list of genuine questions, the answers to which might be valuable when it comes time to apply to colleges. Also help your teen to make a list of â€Å"not-to-be-missed† sites, both on and off campus. It’s impossible for a college tour to include every little place on campus, and most include very little or even nothing of the surrounding area. Your student might be interested in seeing all of the freshman housing options, the athletic fields, or the chemistry lab, but these may or may not be featured during the formal tour. Don’t be afraid to seek them out together after the tour finishes up. Similarly, there might be some off-campus spots of interest, too. Maybe there is a coffee shop around the corner, renowned for being a popular study spot, or a walking trail popular among locals. Maybe your teen is interested in pursuing a job off campus or finding volunteer opportunities. Check these places out now together so that your teen knows what to expect later. Doing some homework ahead of time can mean that college visits are more efficient and effective, leaving fewer questions open when the time comes to send commitment letters. Your teen is probably blushing in advance at the prospect of your overbearing excitement and excessive enthusiasm during a college tour. While it’s natural to be excited and to try to get your child excited too, the tour is the time to dial back your own reactions in order to allow your teen to take the lead and shine. One way to ensure that your student really takes ownership of the experience is by delegating yourself to the spectator role. Allow your teen the opportunity to be the one asking questions and guiding his or her own experience. Of course, this doesn’t mean that you need a gag and blindfold, though. You can take some casual notes and pictures without attracting too much attention. Try to record details that you think your student might find valuable later on. For example, if your child is into acting, taking a brief video of the tour as it passes by the theater might be of interest for your child to review later. This is a simple and unobtrusive way to lend a hand, while your student is busy watching and listening. Afterwards, while the college tour is still fresh in your minds, have a thoughtful conversation with your teen about it. Sit down over a cup of coffee or a snack and encourage your student to reflect on the pros and cons that he or she perceived. Be careful not to offer too much of your own perspective at first. It’s important to hear your teen’s unfiltered perspective first. If you feel there are important things that he or she is forgetting, casually mentioning them is one way to steer the conversation without providing too much of your own opinion. Remember, your teen needs to be at the helm for this experience. Of course, this doesn’t mean that you can’t lend your insights. Once your teen has given some feedback, feel free to give yours, too. Try to frame things in a way that is productive for your student. For example, instead of telling your teen that you’re worried he or she won’t be able to get around without a car and limited public transportation options, ask your teen if he or she noticed any bus stations nearby. If your student doesn’t remember, you may suggest that he or she investigates transportation options more in the future. It can also be helpful to remind your student to write down his or her initial impressions along with a pro/con list as soon as possible after the tour. This will serve as a valuable record later in the college decision process. File it someplace accessible, preferably in the college files that your student has already started. Visiting colleges can sometimes be a stressful experience for parents and teens alike. Approach the visit as a team, allowing your child to guide the experience, and think of yourself as a sounding board. Lend your insights once you’ve heard your child’s, and remember that this visit can be a time to bond together for a successful and productive college tour. It also shows negative amounts which needs to be clarified as, what it means and how it should be taken into account. The Cafà © needs to keep track of the stock and the system should automatically depict that how much stock is left for instance, if a Music CD is sold then the system should automatically decrease one Music CD from the stock record and also show how many more Music CDs are left. Also it has negative figures so if it is a sale amount then how can it be in negative and how to take account of it. Therefore, we have not taken any data from column heading other in calculation of all the questions above.

An ethical dilemma is complex situation emerging from the conflict between moral obligations in which complying with one would result in contravening another (College of Nurses of Ontario [CNO], 2009). Nurses using CNOs ethical conducts and decision-making framework will help in directing their ethical course of action. This framework involves the use of moral component such as claim, evidence, warrant, basis, rebuttal and ethical decision to guide in resolving the conflict (Arnold Boggs, 2011). Thus, the aim of this paper is to use ethical decision-making framework step by step in exploring an ethical issue by analyzing a pediatric case study to make significant decisions. Claim is the first moral component of the framework. It emphasizes on various dilemmas arising from the case study such as pediatric advance directive, consent to treatment by being competent minor and decision-making capacity. The ethical dilemma arises from this case study is whether to choose wishes of adolescent patient considering his treatment or should the wishes of his parents outweigh his request. The case study describes Kyle 14 years old male who has stake in outcome of the decision, and suffering from lymphocytic leukemia cancer. The case study involves Kyle as patient with physicians and his parents to determine the care in best interest of patient. The involved Physicians in care stated Kyles health is deteriorating and not responding to the chemotherapy treatment. Hence, the value of Kyles parents is to continue with the chemotherapy treatment in hope to work and prolong his life. However, Kyle having different point of view, refused to take any heroic measure and aske d for DNR order to be placed in his chart. This way, his parents value would be violated if nurse chooses to accept the decision of Kyle. According to article by Tabak and zvi (2008), patient being mature minor competent has right to refuse treatment and is allowed to choose decisions regarding all the aspects of his treatment. Hence, nurse is caught in conflict between parents and Kyle. Thus, Kyle being in client center care, whichever decision nurse chooses from patient and parents will impact the Kyles care. As a result, parents are going against standards and not performing critical thinking. The evidences found in the case study are true, relevant to make decision, but lacks in sufficiency due to having inadequate in-depth reasoning behind klyes decisions. Warrant is another part of the framework. It requires using professional standard of care, and legal precedents and policies. If I were a nurse confronting ethical dilemma conflict between patient and parents decision over treatment, I would critically examine choices using professional standards. First thing I will take childs age into consideration for informed consent. As stated in pediatric Cancer Society (CPS) (2008), in Ontario there is no age of consent. However, there is mature minor right where patient not being adult in age, but cognitively able are allowed to consider the treatment choices and alternatives based on the evaluation of consequences. This explains Kyle being only 14 years old is able to give consent of refusing treatment, which is on his best interest along with knowing his nature of treatment. As well as, according to CPS (2008), when benefit of the treatment overweighs burden it should be respected. Similarly, Kyles choosing to preserve his quality of life o verweighs the option of treatment associated with pain and suffering which should be respected. Moreover, according to CNA (2008) code of ethics, under promoting and respecting informed decision-making, nurses have right to advocate for the patient if his/her rights are being influences by others decisions. In this case, by abiding this code, I would recognize the kyles right and support his capability to withdraw or withhold the consent for treatment regardless of his parents request. Furthermore, according the CNOs (2009) practice standard ethics clients well-being and client choice are relevant ethical values for nurse when parents and patients view are differentiated in what is beneficial. I as a nurse without judging would evaluate, respect and determine the rationale for the chosen option by parents and patient in terms of benefit vs. risk to assist in making decision. By abiding professional standards and policies will help me as a nurse to have evidence based rationale to de liver ethical clinical care to Kyle. Basis is the next component in the framework involves ethical principles. In this scenario, autonomy, beneficence, and veracity are ethical principles used as guide to analyze ethical issue (Arnold Boggs, 2011). Autonomy refers to patients right to make informed decision about his/her medical care without having anyones influence on it. In this case, parents desired decision takes over Kyles autonomy by contradicting his decision-making capacity (being minor) regarding his treatment and DNR options. Hence, allowing Kyle to make informed decision by allowing him to express his preference, concerns, and wishes would respect his autonomy and will preserve his dignity (Whitty-Rogers et al., 2009). Another principle, beneficence requires to prevent harm to others. In this scenario, kyles going through chemotherapy treatment shows no improvement (beneficences), yet him going through this process for prolong life will increase his pain and suffering. From parental perception, treatment hel ping to prolong lifetime indicates harm in hope of beneficences. For parents, treatment adding to survival period over side effects would appear as convenient option to accept (Mcgrath Phillip, 2008). Last ethical principle veracity refers to responsibility of telling truth. In this case scenario physician or HCP has provided truthful information to patient and family regarding health status and effectiveness of treatment. Hence, there is no other information hidden from patient to help making informed decision. Hence, it is significance for nurse to continue using this principle to support and oppose argument made by each person to solve the conflict. In addition, rebuttal is another component of framework. It focuses on costs and benefits of each choices. The benefit of the choice made by Kyle will alleviate his suffering by refusing the unresponsive treatment and DNR, which will increase his quality of life. It will strengthen the trust in nurse-patient relationship. On the other hand the risk associated with Kyles choice shortens the quantity of life due to having no treatment and DNR actions to rescue his life. Another harm associated is that it would hinder the relationship between parents-patient and nurse-family due to opposing their request. Furthermore, the benefits associated with parental choices of continuing treatment will prolong their and Kyles time of togetherness. As well as, risk associated with parents choice will escalate the pain and suffering of patient by reducing the quality of life. This violates the ethical principle of choosing non-maleficence for the hope of beneficence and reducing patients autonomy an d dignity. As denying parents preference can hinder trusting nurse-patient relationship. Especially when trust, respect and honesty are essential to meet the health care needs of patient and in facilitating end of life care decision making (RNAO, 2006). Although, alternatives could be arranging meeting with parents and patient will help to understand each others perception, as well as allowing to accommodate/negotiate any choices to reach mutual decision. This way parents might be able to see the suffering and pain that treatment brings for child in order to prolong time. Also, Kyle would be able to understand emotional side of parents where his life is more valuable and beneficial over side effect of the treatment. As a result, palliative care could be an alternative option in progressive illness to ease quality of life with quantity of life. Palliative care can benefit in relieving the suffering in holistic way of patients life. For example, chemotherapy being used can have medica tions to relieve side effects of nausea to minimize the suffering (Mcgrath phillip, 2008). As well as, choosing to continue with the unresponsive chemotherapy treatment (side effects) with palliative care may limit the patients quality of life. At last, a nurse being reasonably prudent and ethical should apply moral principles in decision-making. The primary object of the nurse would be to identify ethical issue. The ethical issue in this case study is adolescents treatment decision conflicts with parents decision in determining authority for decision-making. Then nurse will evaluate the evident data to obtain all the relevant and sufficient information. Moreover, nurse should have understanding of CNA, CNOs code of ethics, and RNAO BPGs to have knowledge regarding law, legal action and to have evidence-based rationale in guiding the decision-making process. Nurse would evaluate the claim by recognizing moral reasoning in each persons perspective. According to CNA (2008) values, under client wellbeing and choices, nurse should respect family and patients opinion. Nurse should make parents acknowledge about the adolescents right in making decision. If patient is mature minor and competent to make informed decision then nurse should advocate for patient even if its opposes parental request. Last but not least, nurse should weigh risk and benefits of each persons choices in terms of possible long terms and short-term consequences. Hence, nurse can offer alternative options by collaborating with other HCP if necessary to balance and develop mutual goal between HCP, patient and parents. In conclusion, to achieve resolution in ethical dilemma involves critical thinking. This paper has analyzed an ethical dilemma in determining whether is it Kyle or parents, who has authority to take decision regarding treatment. It evaluated others factors such as pediatric age consent, and being cognitively competent to understand the consequences that could influence the decision-making. Paper also included three nursing journal to support the evidence, professional standards, and ethical principles to direct decision-making. At last, being ethical nurse, to determine decision in patients best interest, possible consequences from the choices were outweighed in terms of risk and benefits. Thus, the use of decision making framework facilitated in deciding what is morally and ethically acceptable in patients best interest while facing ethical dilemma. Kyle is a 14 year old male diagnosed with acute lymphocytic leukemia at age 5. He has endured multiple relapses requiring several rounds of chemotherapy with short periods of remission. He has been readmitted to the paediatric oncology unit after metastases to his lungs and brain have been found. During a family meeting to discuss treatment options, Kyles attending physician explains that the cancer is rapidly progressing and unresponsive to treatment. Kyle feels that he has endured enough and does not want any further heroic measures and has asked that a DNR (do not resuscitate order) be placed in his chart. Kyles parents do not agree with this course of action and are holding onto to hope that more treatment may prolong his life.

He or she probably thinks of charms, spells, wizards, and disappearing doves. The term "Realism" may represent the everyday world-that with which we are already familiar. Could these two words ever be coupled together to represent one idea? Magical Realism represents the marriage of these two words. A name originally given to a new art form in the early twentieth century, Magical Realism evolved into a literary genre and now represents much more-an attitude, the window through which to view the world, a philosophy of life. By examining the history, theory, and evolution of Magical Realism, this term, seemingly an oxymoron, will make sense. The term Magical Realism is thought by most critics to have originated in the early twentieth century as a new art form. Franz Roh, to whom we attribute having coined the term, describes this "new" art form in his 1925 article "Magical Realism: Post Expressionism." Roh defines Magical Realism through a chronological examination of artistic styles preceding this "new art." The two periods on which he focuses primarily are Impressionism and Expressionism. Essay --

Hello everyone! I am thrilled to announce that I will once again be miniaturized along with my submarine and take you on another Fantastic Voyage inside the human body. In case you have forgotten the details of our last journey, my sub and I will be shrunken down to be 8 microns long. This time I will be swallowed by Fred, a 55 year old man, while he enjoys a hamburger, French fries, and root beer. As I pilot my way through his body, I will be describing the process of digestion and what major structures I see and come across. Can you imagine being part of someone’s meal? Neither can I, yet here I am being chewed and mixed with a juicy burger by Fred’s teeth. As Fred enjoys his meal, the first part of digestion is happening in his oral cavity. Fred’s burger is a mixture of carbohydrates, lipids, and proteins. As he chews and moves his food around with the help of his tongue, I can see his saliva coming from different angles and mixing with his food. There are three pairs of salivary glands, the parotids, submandibulars, and sublinguals. They secrete most (about 1L) of the saliva produced each day in an adult. (Thibodeau & Patton, 2008, pg397) Saliva contains mucus and a digestive enzyme called salivary amylase. As you can see here, the process of chewing combined with this mucus is allowing the food to break down into a small bolus. After this process I am now mixed up with the bolus and with the help of Fred’s tongue, I have began moving down into the pharynx and then down t o this muscular tube called the esophagus. The esophagus is a stretchy pipe, about 25 centimeters that carries food and liquids from the throat to the stomach for digestion after it has been chewed and chemically softened in the mouth. Analysis of the poem Essay

The poem Originally by Carol Ann Duffy talks about the issue of culture identity. The poem talks about change, memories, and anxiety which occurs when moving. This is conveyed through the experiences of a young girl in the poem who is reluctant to leave what she knows behind. This is made apparent through the theme of memory and the continual change of setting. The title Originally sets the tone for the poem as there change needs to occur for there to be an ‘original’. This choice of diction allows for an expectation for what the journey will be about, while the ambiguity of the poem is written in such a way that personal experiences can be projected upon the protagonist. The aspect of the poem through tone however creates a bias towards negative emotions and experiences due to the despondent tone throughout the first two stanzas. This atmosphere of loss is aided through the use of negative emotive diction such as ‘bawling’ and ‘resigned’. By showing that the protagonist’s brothers are crying, Duffy illustrates how hard this is for them as crying is usually only brought on by major or sad events and loss, ‘resigned’ is used to show how she has accepted her fate, but it doesn’t mean she likes it. This association of emotions with the diction allows for empathy to occur towards the protagonist and her unsure feelings about her emigration. The theme of cultural identity is used in the poem in order to instil a sense of not belonging. This feeling of unease and unhappiness is introduced through the use of ‘bawling’ as this change from the place where they are comfortable and belong to the new one is both painful and confusing for them. The use of italics however, in the repetition of ‘Home’ as well as the capitalisation of it, emphasises it’s importance to them and their desire to return to it. The use of a blind toy by Duffy can be used as a metaphor towards the protagonists new life, where, although the toy is blind, it still has eyes. The foreshadowing could be that when the protagonist moves she will be blinded by everything which is new so that she doesn’t become overwhelmed by it. She will continue to be blind to the beauty of her new home so long as she is yearning for her old one. However, once she is ready her ‘sight’ will return and she will start to forget her cultural identity. At the time, the girl doesn’t want this however, so she is clinging onto a toy to maintain her memories of home. Additionally, a toy is associated with childhood, so the clinging onto it may represent how she doesn’t want to grow up and leave her comforts behind. By saying in the second stanza that ‘all childhood is emigration’, Duffy allows for immediate relation to the protagonists situation. This is due to the journey of growing up to adulthood which is a worldwide experience, as well as referring to physical emigration of moving from one place to another. Improtantly however, the emigration of childhood is all made without the acceptance of the person moving, they cannot stop growing older, and parents make the ultimate decisions. This unease and the inability to understand the need to move is reinforced by the location of her new home where ‘no one you know stays. ‘ This introduces the tone of isolation which is reinforced by having the wrong accent, and ‘shouting words you don’t understand’ which immediately marks a person as being from a different area, even though the move could have been within the same country of city, the accent and slang changes. The introduction of ‘big boys’ shows that she is intimidated by people from the area who are older and bigger as she doesn’t know how they will react, this is reinforced by the alliteration present through the repetition of the hard ‘d’, continuing the feeling of intimidation which the protagonist encounters. A continuation of the alliteration in sibilance, ‘seeing your brother swallow a slug, feel only a skelf of shame,’ provides an insight that the protagonist is slightly proud of her brothers for adapting so well to the environment, which is then applied to herself in a continuation of sibilance in combination with a simile in that she ‘remembers (her) tongue shedding it’s skin like a snake, my voice in the classroom sounding just like the rest. ‘ This shows that she is also now adapting to her environment, reinforced by the fact that a shed skin is natural for a snake, and this adaptation is normal, although slightly unwanted. The last stanza’s change in tone shows how the protagonist has changed with age. This allows for a time skip to take place into a time when she is more mature and able to reflect upon the journey easily, although with some regret. This is expressed through rhetorical questions beginning with the use of ‘Do I only think,’ in line 20, which builds up an atmosphere of longing and wistfulness. There is also a tone of uncertainty in there, as she doesn’t know if she had remained in the place if the feelings of belonging would have remained, which is why she only questions and doesn’t outright believe that staying would have been the best option for her. The rhyming of the words ‘first space’ and ‘right place’ reinforces the doubt she feels about her cultural identity. The continued doubt of the protagonist’s cultural identity which occurs in lines 23 and 24, illustrates how she will continue to try and find the answers throughout her life as she will never be truly certain of who she is, creating a sense of not belonging. Although emigration is a hard thing to experience, Duffy illustrates that trying to maintain a cultural identity through such a process may cause problems later. The continued rejection of the new culture illustrates how much of an outsider it makes the protagonist feel later in life, which could have been avoided if it had been readily embraced. The place which she originates from will always have a draw, however, the acceptance of a new culture viewed as a new part of a personal culture, would be much easier to accept than a replacement to the old one.

The nave of Amines Cathedral The Amines cathedral is the tallest complete cathedral in France, its stone-vaulted nave reaching an internal height of 42. 30 meters (138. Oft). The nave of Santa Crock Santa Crock is the largest Franciscan church in Florence. The construction started in 1295 by architect Arnold did Cambial and completed in 1442. They published Schedule B rates based on the calculation that stone would be available within 26 chains. The appellant inspected the site and found that there was stone available for construction within 26 chains. Satisfied he submitted a tender at 13% below the rates given in Schedule B on 30th September, 1946. Finally the tender was accepted and contract signed on 20th November, 1946.However when the appellant tried to take stone from the specific area, he was stopped by Cantonment authorities. Furthermore he was not given permission from the Cantonment authorities for the removal of stones. As a result he had to get stone from Gadhera and Bhumedar from a distance of 79 and 110 chains respectively. Also during the construction of the road he encountered very hard shale rock that wasn’t mentioned in the contract as result of which he had to do some extra work. He requested for a higher rate from PWD but was rejected.After that he commenced the work, finally when the work was finished the Executive engineer forwarded his request for a higher rate. In his letter dated 15th June 1950 he mentioned that since the appellant was unable to get the stone from within 26 chains and had to bring it from outside, he is entitled to get extra compensation. Under para 5 of the contract the appellant must be prepared to execute the work at original tender rate in excess of the given quantities of work upto 30 % and if he works in excess of 30% he is entitled to refuse the work if the rates are not increased.Since the appellant worked in excess of 30% he claimed a higher rate of payment for this extra work – Rs 48,840 due as balance together with interest by way of damages at 12% amounting to Rs 17,582 making a total of Rs 66,422. When this claim was rejected the appellant gave notice under Section 80 of the CPC and filed a suit for the above amount. The defendant-respondent resisted the suit due to 3 reasons – 1) No assurance was given to the appellant by officers of the PWD as alleged by them. ) Quantity of very hard shale rock shown by the appellant was false. 3) Under para 5 of the contract the appellant must be prepared to execute the work at original tender ra te in excess of the given quantities of work upto 30 % and if he works in excess of 30% he must intimate to Engineer-in-charge in writing his willingness or refusal to do extra work at original rates and if he refuses to carry on at the original rates he is required to settle fresh rates for increased work over 30% before doing the work.The appellant did no such thing but continued to work even after it went in excess of 30%. The trial court held issues 1, 2, 6 and 7 in favour of the appellant while issues 3, 4 and 5 were decided against him. As a result a decree for a sum of Rs 20,495 for extra lead plus Rs 1,653 for extra work done under the item very hard shale and Rs 4,155 interest by way of damages on Rs 22,158 making it a total of Rs 26,313 was passed with interest at 3 per cent per annum. The High court however reversed the decree for 2 reasons – ) Employment of the figure 26 chains was for no other purpose that that of calculation, it could not be held give any assura nce/guarantee to the contactors that they would get stone within the distance. 2) Plaintiff – appellant performed the work required of him without exercising his right under para 5 of the contract which gives him right to demand fresh rate in due of excess work done by him above 30 %. The appeal of the respondent was allowed and the suit dismissed. The case was taken for trial in the Supreme Court and the judgement is as given subsequently.Issues There were two main issues. 1) Whether the estimate of the PWD formed part of the contract so as to be binding on both parties and whether any assurance were given to the appellant that he would be given higher rates from bringing the stones from places situated at 79 chains and 110 Chains respectively. 2) Whether clause 5 of the special conditions of the contract was applicable to the extra item of work and whether he was entitled on the assurances given by the local officers to higher rate for the extra work done. Judgement ) a) In -none of the clauses of the tender notice or conditions of contract or in any other document was there any assurance that if stone was not available at the distance of 26 chains the appellant would ‘be paid higher rates. It was for the appellant to have satisfied himself before entering into the contract that the Cantonment authorities would permit him to take the stone. Since be commenced work after his request for higher rate was rejected, it could not be said that the appellant was in any way induced by any assurance. The Executive Engineer’s letter was only recommendatory and did not establish any right to obtain a higher rate. ) It could not be said that once stone was not available at a distance, of 26 chains, the contract was at an end and that because the appellant had done the work, he should be paid on the basis of quantum meruit. That remedy would be available only when the original contract had been discharged by the defendant in such a way as to entitle the plaintiff to regard himself as discharged from any further performance, and be elects to do so; but, where work is done under a contract persuant to its terms no amount can be claimed by way of quantum meruit. Adopi Parshad & Sons.Ltd. v. Union of India, [1960] 2 S. C. R. 793, followed. 2) The appellant could not succeed on second point also because under clause 12 of the contract Ext. B-1, the plaintiff was bound to perform additional work up to 30% on the same terms and conditions on which he undertook to do the work. The quantity of work that appellant performed was far in excess of what was mentioned in Ext. B-3. The Appellant therefore claimed payment for the work done by him in excess of the quantity mentioned in the contract plus 30% at the current rate as against the stipulated rates.Para 5 of the special instructions provides as follows: â€Å"Contractors must be prepared to do at their original tender rate in excess of the given quantities of work up to 30%. If an increa se in excess of 30% is ordered over the work, the contractor must intimate in advance his willingness or refusal to work at the originally tendered rates. In the latter case, he should also settle fresh rate for increases work over 30% before doing the work. Since there is no evidence nor it is claimed by the appellant that he had given any notice as required under Para 5 of the pecial instructions and since he did the work without fulfilling these requirements he is not entitled to claim any amounts at a higher rate for extra work done. Sections/Acts Sec 73 Indian Contract Act, 1872: Compensation for loss or damage caused by breach of contract. – When a contract has been broken, the party who suffers by such breach is entitled to receive, from the party who has broken the contract, compensation for any loss or damage caused to him thereby, which naturally arose in the usual course of things from such breach, or which the parties knew, when they made the contract, to be likel y to result from the breach of it.Such compensation is not to be given for any remote and indirect loss or damage sustained by reason of the breach. Compensation for failure to discharge obligation resembling those created by contract – When an obligation resembling those created by contract has been incurred and has not been discharged, any person injured by the failure to discharge it is entitled to receive the same compensation from the party in default, as if such person had contracted to discharge it and had broken his contract. Explanation. In estimating the loss or damage arising from a breach of contract, the means which existed of remedying the inconvenience caused- by the non- performance of the contract must be taken into account Contract Claim on basis of Quantum Meruit The term â€Å"quantum meruit† means â€Å"as much as is merited† or â€Å"as much as earned†. It provides that where a person has done something or rendered some service for a nother, or delivered goods to him not intending to do so gratuitously, then he is entitled to recover a reasonable sum in case the contract has not been fully performed.Grounds for Claiming on the basis of quantum meruit: a. Work done in pursuance of a contract which has been discharged due to the defendant. b. Where services are rendered under an agreement which is discovered to be void. c. Where a person enjoys the benefit of a non-gratuitous act (Section 7). d. Where the contract is divisible and the party has enjoyed the benefit of the work done. Limitations: a. Where a contract requires complete performance. b. A person who is himself guilty of breach cannot sue on quantum meruit. . Any claim upon the basis of quantum meruit cannot be entertained unless there is evidence of an express or implied promise to pay for the work which has already been done. Others Cited Cases Alopi Parshad and Sons v. Union of India – This case was cited for the help to understand the present case for the interest as Damages or interest on damages. Case mentioned that the compensation on the principle of quantum meruit is awarded for work done or services rendered when the price thereof is not fixed by contract.It means when there is express term of an agreement the quantum meruit will not apply. As there is agreement and rates are fixed there cannot be any implied contract as express contract is present. Thus compensation quantum meruit cannot be awarded. Conclusion Quantum Meruit: The general rule is that unless one party has performed his obligation in full. He cannot claim performance from the other. However in certain cases, when one party has done some work under the contract and contract gets discharged due to some reason (not because of the party which has done some work).He is entitled to be paid for the work he has done.
